Welcome to Big Little Victories (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, www.biglittlevictories.com (“Website” or “Platform”). By accessing or using our Website, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

1. Eligibility

You must be at least 18 years old to use our Platform. By using our Platform, you confirm that you meet this age requirement.

2. Services & Digital Goods

Big Little Victories provides digital goods and services for personal use only. All sales are final, and due to the nature of digital goods, we do not offer returns, exchanges, or refunds. Users may create an account; however, they are not permitted to link or attach social media accounts. Users are also not allowed to upload content, leave reviews, or advertise or sell their own goods and services on our Platform. Additionally, our Platform does not offer subscriptions.

3. Purchases & Payments

All payments on our Platform are processed through Wix Payments, which supports Visa, MasterCard, American Express, Discover, and PayPal. Transactions are conducted exclusively in U.S. dollars ($USD).

4. Prohibited Conduct

Users of our Platform may not engage in any of the following activities:

• Selling, transferring, or advertising any products or services.

• Sharing, distributing, or reproducing purchased digital goods beyond personal use.

• Attempting to modify, hack, or disrupt the Platform.

• Engaging in fraudulent, misleading, or unlawful activities.

5. Third-Party Links & HIPAA Compliance

Our Platform includes links to our HIPAA-compliant electronic medical records (EMR) software for any visitor of our site requesting screening or speech, langauge, or feeding therapy services. However, we do not host third-party advertisements.

6. Dispute Resolution & Governing Law

If a dispute arises, both parties agree to attempt informal negotiations before pursuing legal action. If the dispute remains unresolved, it will be settled through binding arbitration in Illinois, Cook County. Arbitration fees are the responsibility of the parties involved, and we will not pay for arbitration fees. If litigation is necessary, it must take place in Illinois, Cook County. Users must bring any claims within one (1) year of the event giving rise to the claim.

7. Liability & Limitations

Our liability for any claim is limited to the amount the user paid for the specific digital good or service. We are not liable for indirect, incidental, or consequential damages.

8. Privacy Policy

Your use of our Platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data.

9. General Terms

These Terms are governed by the laws of the United States, State of Illinois. Users may not sell, transfer, or assign their accounts. We reserve the right to modify these Terms at any time, and continued use of our Platform constitutes acceptance of any updates.
